Description
Plaintiff, a minor, appearing by his guardian ad litem, hurt himself at the public bathing beach constructed and maintained by defendant city. His complaint alleges that the city violated sec. 101.06, Stats., (the safe-place statute) being guilty thereby of both gross and ordinary negligence; gross and ordinary negligence of the citys lifeguard on duty at the time of the accident; and ordinary negligence of the citys director of recreation who had supervising authority over the premises. The derelictions were alleged with great particularity and were pleaded in a single complaint as separate causes of action against, respectively, the city, the lifeguard, and the director. Plaintiff has alleged that his injuries were caused by such derelictions.
